FlixPal respects the intellectual property rights of others and expects users of its website, software, and related services to do the same.
If you believe that any content, material, or activity associated with FlixPal infringes your copyright, you may send us a written notice under the Digital Millennium Copyright Act ("DMCA"). Upon receiving a valid notice, we may review the claim and take appropriate action, including removing or disabling access to the material at issue where appropriate. The DMCA notice-and-takedown framework and counter-notice process are described in Section 512 of Title 17 of the United States Code.
1. DMCA Contact Information
Please send DMCA notices and counter-notices to:
- Fabsoft Technology Limited: 2G Hok Yuen St, Hok Yuen, Hong Kong
- Email: contact@flixpal.org
- Website: https://flixpal.us/contact
2. How to Submit a DMCA Notice
To be effective, your DMCA notice should be a written communication that includes substantially the following information:
- your physical or electronic signature;
- identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list of those works;
- identification of the material claimed to be infringing, or to be the subject of infringing activity, and information reasonably sufficient to allow us to locate it;
- information reasonably sufficient to allow us to contact you, such as your full name, address, telephone number, and email address;
- a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please make sure your notice is complete and accurate. Incomplete notices may delay our review.
3. What Happens After We Receive a Notice
After we receive a DMCA notice, we may:
- review the notice for completeness;
- request additional information where necessary;
- remove or disable access to the identified material;
- notify the affected user or party, where appropriate;
- take further action if required by law or our internal policies.
Submitting a false, misleading, or incomplete notice may result in rejection of the notice or other consequences under applicable law.
4. Counter-Notification
If you believe that material was removed or disabled by mistake or misidentification, you may send us a written counter-notification.
To be effective, a counter-notification should include substantially the following information:
- your physical or electronic signature;
- identification of the material that was removed or disabled and the location where it appeared before it was removed or disabled;
- a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address, and telephone number;
- a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which the service provider may be found;
- a statement that you will accept service of process from the person who submitted the original notification or that person’s agent.
If we receive a valid counter-notification, we may forward it to the original complaining party and handle the matter in accordance with applicable law.
5. Repeat Infringers
FlixPal may, in appropriate circumstances and at its discretion, suspend, restrict, or terminate access for users or accounts that are found to be repeat infringers or that repeatedly violate intellectual property rights.
6. Good Faith Use of This Process
This DMCA process may be used only for copyright complaints made in good faith.
It may not be used for unrelated disputes, competitive complaints, false claims, abusive requests, or attempts to remove lawful content.
If you are not sure whether the material you are reporting is infringing, you should consider seeking legal advice before submitting a notice.
